Ticketmaster and Live Nation Ruled a Monopoly in U.S. Trial

A federal jury in New York has concluded that Live Nation and Ticketmaster functioned as an illegal monopoly within the ticketing and live events sector. The decision validates long-standing grievances that the entertainment behemoth was actively suppressing competition and artificially inflating consumer costs, CNN reports.

Following extensive proceedings that featured testimony from prominent figures across the music and entertainment spheres, the jury commenced deliberations on Friday before delivering their verdict.

Despite the ruling, gig-goers should not expect an immediate reduction in ticket prices or supplementary fees. Judge Arun Subramanian is scheduled to preside over a subsequent trial to determine the appropriate course of action. Potential remedies could range from mandating structural overhauls to forcing the company to sell off specific business divisions or even ordering a complete dissolution of the enterprise.

Scott Grzenczyk, a lawyer at the firm Girard Sharp, described the outcome as a seismic shift for public perception.

«There’s a big difference between people complaining about Goliath and getting a jury verdict that Goliath was a monopolist and doing something wrong,» he noted.

Live Nation issued a statement on Wednesday rejecting the jury’s findings and confirming its intention to appeal any adverse rulings. The company emphasised that the verdict is not the definitive conclusion to the dispute.

The secret settlement and state backlash

The legal battle began in 2024 when the U.S. Justice Department (DOJ) teamed up with 39 state attorneys general to sue Live Nation. They argued that the merger with Ticketmaster gave the corporation unprecedented control over almost every facet of the live music ecosystem to the detriment of fans, artists and venues.

However, the trial took an unexpected turn during its second week when the DOJ abruptly reached a confidential settlement with Live Nation. While a small number of states agreed to the terms, more than two dozen opted to press on with the trial.

This sudden settlement emerged shortly after the DOJ ousted its antitrust division chief, Gail Slater, who was renowned for her fierce approach to such cases. Following the jury’s decision, Slater took to social media to commend the coalition of states that continued the fight, stating they had made «antitrust history».

Under the terms of the DOJ’s separate agreement, Live Nation committed to allowing rival platforms like StubHub and SeatGeek to sell tickets for its events. The deal also caps service fees at 15%, forces the divestment of exclusive booking contracts at 13 amphitheatres and establishes a $280 mln compensation fund for the states that signed the pact. This settlement still requires judicial approval.

Bipartisan action and future impacts

California Attorney General Rob Bonta praised the successful stateside effort, highlighting the importance of state intervention during a period of reduced federal antitrust enforcement under the Trump administration.

He expressed immense pride in the bipartisan coalition of states that united to shield consumers and local economies from Live Nation’s unlawful practices. Similarly, New York Attorney General Letitia James stated that the jury had simply confirmed what the public had known for years.

The jury specifically determined that Ticketmaster had overcharged states by $1.72 per ticket, aligning closely with preliminary estimates. The final sum for total damages and penalties will be decided by the judge in due course.

Legal experts caution that the road to fairer ticketing is long. Grzenczyk pointed out that the courts are unlikely to simply order a flat price reduction. Instead, the focus will be on forcing behavioural changes to foster a more competitive market, warning that it could take a considerable amount of time before consumers truly feel the financial benefits.
